TERMS AND CONDITIONS OF SERVICE — BEVIBRANT FOURTHWALL STORE

These Terms of Service (“Terms”) govern your use of the BeVibrant storefront powered by Fourthwall on which they appear (the “Store”). The Store is operated for BeVibrant by BE VIBRANT FZ-LLC, a Free Zone Limited Liability Company registered and licensed in the Ras Al Khaimah Economic Zone (“RAKEZ”), United Arab Emirates (“BeVibrant,” “we,” “us,” or “our”).
By using the Store, you agree to these Terms to the extent permitted by law. If you disagree, do not use it. Store purchases are separately governed by Fourthwall’s checkout terms.
Nothing here excludes, restricts or waives a consumer, privacy or other right that applicable law does not permit the parties to exclude, restrict or waive.
1. Scope and Other Policies
The Store may display or provide garments, accessories, music, digital downloads and other BeVibrant products or content (“Products”). These Terms govern your relationship with BeVibrant concerning Store use, BeVibrant content, submissions and licences granted by BeVibrant. They do not replace Fourthwall’s Product Order terms.
These Terms must be read with the Store Privacy Policy, Fourthwall’s Merchandise Terms of Service and Privacy Policy displayed in the Store footer or at checkout, the Store Shipping Policy, the Store Return & Refund Policy, and any Product-specific terms or digital licence.
BeVibrant’s separate Squarespace website at https://BeVibrant.co is governed by the Website Terms at https://BeVibrant.co/terms and Website Privacy & Cookie Policy at https://BeVibrant.co/privacy-policy. Those documents do not replace these Store Terms.
A specific Product term controls for that Product; the Shipping or Return & Refund Policy controls its subject; Fourthwall’s terms control the Fourthwall sale and checkout; and mandatory law always prevails where it cannot be changed by contract.
No BeVibrant membership, paid-video or recurring service is promised by these Terms. Before one is enabled, its price, renewal, cancellation, access, content and refund terms will be disclosed.
2. BeVibrant and Fourthwall Have Different Roles
Fourthwall provides the Store platform. Under Fourthwall’s current platform terms:
•    Fourthwall—not BeVibrant—is the seller and merchant of record for Products and Memberships sold through the Store;
•    a Product Order is between Fourthwall and the customer;
•    Fourthwall processes payments and transaction taxes; and
•    sourcing, fulfilment, shipping, support, returns and refunds are allocated under Fourthwall’s terms and the arrangement for the Product.
BeVibrant may design, promote or supply Products, own their creative rights, provide digital content, assist customers, or perform certain fulfilment or support functions. BeVibrant does not promise anything on Fourthwall’s behalf or alter its checkout, payment, tax or transaction duties.
These Terms are between you and BeVibrant. Fourthwall is not a party to them. Nothing here removes or increases Fourthwall’s separate duties or liability under its terms or mandatory law.
3. Eligibility, Accounts and Security
You must have legal capacity to use a feature or order. Minors need parent or guardian authorisation where required, and the Store is not directed to children under 13. Provide accurate account information, protect credentials and promptly report suspected compromise. Reasonable verification may be required. If acting for another party, you confirm authority to bind it.
4. Store Permission and Intellectual Property
BeVibrant gives you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable permission to use BeVibrant-controlled Store features for lawful, personal and non-commercial purposes.
BeVibrant’s name, marks, identity, designs, artwork, product presentation, photographs, graphics, text, music, recordings, compositions, videos and other original or licensed material (“BeVibrant Content”) are protected by intellectual-property and unfair-competition laws.
Without written permission or a non-waivable legal right, do not copy, modify, distribute, sell, license, commercially exploit, remove notices from, imitate for manufacture, compile into a dataset, or use BeVibrant Content for artificial-intelligence or machine-learning development. Normal public links are permitted. All other rights are reserved. Third parties own their respective technology and materials.
5. Product Information, Orders and Payment
Before ordering, review all descriptions, materials, dimensions, sizing, compatibility, included files, care information, prices, availability, estimates and restrictions.
Colours, textures and scale may vary because of lighting, photography or screens, and measurements may have reasonable manufacturing tolerances. Ordinary variation does not excuse a materially misleading description.
Products, editions, sizes and quantities may be limited. Cart placement does not reserve inventory. Availability can change before acceptance. Order formation, acceptance, rejection and cancellation are governed by Fourthwall’s terms and mandatory law.
Checkout shows the applicable price, currency, shipping, tax and other charge. Fourthwall processes payment as merchant of record. BeVibrant does not normally receive or store full card numbers, CVV codes or online-banking credentials.
A genuine pricing, inventory or technical error may be corrected where lawful. Payments for lawfully cancelled or rejected orders are handled through Fourthwall’s refund process. This clause will not defeat a binding advertised price where law prohibits it.
Use only a payment method you are authorised to use. Fraudulent payments, chargeback abuse and disputing a legitimate charge instead of contacting support are prohibited. Genuine card-network, chargeback and statutory rights remain unaffected.
6. Physical Products, Shipping, Final Sale and Defects
Choose sizes, variants and delivery details carefully. A customer-selected error is not a Product defect. Contact Store support immediately; changes may become impossible after fulfilment begins.
Dates are estimates unless expressly guaranteed, and orders may arrive separately. Carrier delay, customs, failed delivery, address errors, duties and import restrictions are governed by the Shipping Policy, Fourthwall’s terms and law.
Except where the Return & Refund Policy, Fourthwall’s terms or mandatory law provides otherwise, Store sales are final, and voluntary returns or exchanges for change of mind, buyer’s remorse or a customer’s incorrect size or variant selection are not accepted.
This rule does not remove rights for a Product that arrives damaged, defective, incorrect, incomplete, unsafe or materially different from its description. Report a genuine issue promptly through the Store contact process with the order number, checkout email and, where reasonably requested, clear photographs or relevant evidence. Depending on the Product, fulfilment arrangement, policy and law, the remedy may include repair, replacement, price reduction or refund. A procedure or evidence request will not eliminate a non-waivable right.
7. Digital Music and Other Digital Products
Unless a written licence grants more, lawful purchase and delivery gives the purchaser a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the supplied files on personal devices.
The purchase does not transfer copyright, master, composition, publishing, trademark or ownership rights. Unless a written licence or non-waivable law permits it, you must not:
•    share, upload, mirror, redistribute, resell or sublicense the files;
•    make them available through a file-sharing, streaming or download service;
•    broadcast, publicly perform, synchronize, sample, remix, edit or incorporate them into another work;
•    use them in advertising, merchandise, films, games, applications, monetised content or another commercial project;
•    remove metadata, ownership information, watermarks or access controls;
•    share credentials, access links or download URLs; or
•    use them for model training, voice cloning, synthetic media or another artificial-intelligence system.
A Product-specific written licence controls where it expressly grants broader use. Non-waivable statutory licences and exceptions remain unaffected.
Check listed formats and requirements. Contact support if a digital Product is faulty, inaccessible or misdescribed. Except where Fourthwall’s terms, the Return & Refund Policy or mandatory law says otherwise, digital sales are final once delivery, access, download or streaming begins. Any legally required consent and acknowledgement for immediate supply controls.
If a purchase is lawfully refunded, reversed or cancelled, its digital licence ends and you must stop using and delete the files unless law provides otherwise. BeVibrant may suspend access or revoke a licence for verified fraud, unlawful redistribution or another material breach, subject to mandatory rights and reasonable process where appropriate.
8. Promotions, Quantity Limits and Resale
Promotions apply only on their stated eligibility, Product, territory, quantity and time conditions, cannot be combined unless stated, and have no cash value unless law requires. Abuse may be rejected.
Products are offered primarily for end use. Do not use bots, scripts, false identities, multiple accounts, coordinated checkouts or address manipulation to evade limits, interfere with fair access or obtain inventory for unauthorised bulk commercial resale. BeVibrant may impose per-order or per-cart limits and ask Fourthwall to review abusive orders where its terms and law allow.
Nothing restricts a lawful resale right that cannot be waived. A reseller must not remove or falsify labels, misuse BeVibrant marks, claim authorisation, confuse consumers, or sell counterfeit, altered or unsafe Products.
9. Reviews, Messages, Support Files and Ideas
Submissions must be accurate, lawful, authorised, non-infringing and free of malware or deception. Do not include unnecessary credentials, identification or sensitive information.
You retain lawful ownership and permit BeVibrant to process submissions as needed for support, security, compliance or claims. Public reviews, ratings, photographs and comments may be displayed and reproduced with the Store or reviewed Product. Private support material will not become advertising without permission.
Unsolicited creative ideas create no confidentiality, employment, partnership, review or payment duty. You keep existing rights, while BeVibrant may use work independently developed, already known or lawfully obtained elsewhere.
Support is not an emergency service. A message does not amend an order or these Terms, guarantee a response time, subscribe you to marketing or constitute formal legal service unless mandatory law says otherwise.
10. Prohibited Conduct
You must not:
•    use the Store unlawfully, fraudulently or deceptively;
•    infringe rights or impersonate BeVibrant, Fourthwall or another person;
•    access another account or order without permission;
•    use malware, denial-of-service, credential attacks, test-card attacks or harmful code;
•    scrape or extract Store data through unauthorised automation;
•    bypass checkout, inventory, security, download limits or access controls;
•    reverse engineer Store technology except where law expressly permits;
•    harvest personal information, spam, harass, threaten or deceive;
•    abuse promotions, refunds, returns, payment disputes or support; or
•    share restricted content, digital files, credentials or private links.
Attempting, assisting or encouraging a prohibited act is also prohibited. Ordinary browser use, authorised search-engine indexing and non-waivable lawful activity remain permitted.
11. Enforcement, Third Parties and Availability
BeVibrant may investigate misuse, preserve records and take proportionate action, including removing BeVibrant-controlled content, restricting BeVibrant-provided access, revoking a digital licence for material breach or asking Fourthwall to review an account or order. Fourthwall independently controls platform accounts, checkout and Product Orders.
Immediate action may be taken for credible fraud, piracy, cyberattack, safety risk or legal requirement. Where reasonable, BeVibrant may give notice or an opportunity to address a less urgent breach. Suspension does not erase an accrued right or mandatory consumer, refund, complaint or privacy right.
The Store depends on Fourthwall and other providers whose terms may apply. BeVibrant does not control their systems or guarantee uninterrupted availability or universal compatibility. A link or integration alone creates no affiliation, agency, partnership or endorsement.
BeVibrant may correct, modify, suspend or discontinue BeVibrant-controlled content or features, but may not retroactively remove an accrued transaction or consumer right.
12. Disclaimers and Limitation of BeVibrant Liability
To the fullest extent permitted by law, BeVibrant-controlled Store content and functionality are provided on an “as available” basis, and BeVibrant disclaims implied warranties concerning Store access or informational content only where they may lawfully be disclaimed.
Product obligations and remedies are governed by Fourthwall’s terms, Product descriptions, Store policies and mandatory law. BeVibrant does not disclaim an express promise, its own unlawful conduct or a non-waivable right.
Liability for a Fourthwall Product Order is allocated under Fourthwall’s terms and mandatory law. These Terms do not make BeVibrant the seller or make Fourthwall responsible for BeVibrant’s independent content, licences or conduct.
To the fullest extent permitted by law, BeVibrant is not liable under these Terms for indirect, incidental, special, punitive or consequential loss, or loss of profit, revenue, opportunity, goodwill or data, where that loss may lawfully be excluded. BeVibrant’s aggregate liability arising solely from these Terms or BeVibrant-controlled Store use, excluding Product Order liability allocated to Fourthwall, will not exceed the greater of USD 100 or the amount paid directly to BeVibrant for the specific BeVibrant service giving rise to the claim during the preceding 12 months.
These limits do not apply to fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury where liability cannot be limited, a non-waivable privacy or security duty, mandatory Product or consumer remedies, or any liability law does not permit BeVibrant to limit. An unenforceable limit applies only to the maximum lawful extent.
13. Responsibility for Deliberate Misuse
To the extent permitted by law, you are responsible for direct loss and reasonable external legal cost caused by your deliberate unlawful Store use, fraud, cyberattack, unlawful digital redistribution, rights-infringing submission or material breach.
If that conduct causes a third-party claim against BeVibrant, you will indemnify BeVibrant only to the extent the claim and reasonable cost were caused by you. This does not make a consumer responsible for BeVibrant’s breach, negligence or unlawful conduct or restrict a non-waivable right.
14. Changes, Law and General Terms
BeVibrant may update these Terms prospectively for Store, Product, provider, practice or legal changes. The “Last Updated” date identifies the version. An update does not retroactively rewrite a completed Product Order, remove an accrued right or expand restrictions on a previously granted digital licence. Required notice or consent will be provided.
These Terms and non-contractual matters between you and BeVibrant are governed by UAE federal law and law applicable in Ras Al Khaimah, without displacing mandatory law. Subject to any mandatory right to proceed elsewhere, Ras Al Khaimah courts have jurisdiction. Fourthwall Product Order disputes remain subject to Fourthwall’s terms and mandatory consumer forums.
Before filing a BeVibrant claim, the parties should try in good faith to resolve it through support@BeVibrant.co. This does not prevent urgent relief, filing before a deadline, reporting to an authority or using a consumer process.
These Terms, the Store Privacy Policy and Product terms form the BeVibrant Store-use agreement, not the Fourthwall purchase contract. An unlawful term is limited only as necessary; the rest continues. Delay is not waiver. BeVibrant may assign these Terms in a lawful business transfer; you may not transfer them to evade restrictions. No agency, partnership or joint venture is created.
BeVibrant is not responsible for delay outside its reasonable control where law permits, but this does not excuse required mitigation, notice or remedy. Notices may be electronic. Where UAE law requires Arabic consumer information or terms, this English version does not displace that requirement. Headings are for readability.
15. Official Communications, Scams and Contact
BeVibrant directly controls only:
•    support@BeVibrant.co — the official and only direct address for customer support, Store-order assistance, complaints, security, intellectual-property and privacy; and
•    info@BeVibrant.co — the official campaign sender for music, launches, creative projects, brand announcements and promotions. It is not support.
Legitimate receipts, payment notices, support messages, digital-delivery emails, fulfilment updates, shipping notices or tracking messages may also come from Fourthwall, the Store-specific support channel and authorised payment, fulfilment or delivery providers. Another address claiming direct BeVibrant control is unverified unless confirmed through support@BeVibrant.co.
BeVibrant will not use an unsolicited message to request your password, one-time code, full card number, CVV, remote device access, or gift-card or cryptocurrency payment. Verify unexpected messages through the Store, order-status page, https://BeVibrant.co or the provider’s independently located website. Report impersonation to support@BeVibrant.co. To the fullest extent permitted by law, BeVibrant is not responsible for acts caused solely by an unaffiliated scammer it did not authorise or control; this does not exclude BeVibrant’s own responsibility or mandatory liability.
